GENERAL TERMS AND CONDITIONS OF WORK ZERMATT
1. services
WORK ZERMATT
takes over the selection of specialists and managers for you. It is
very important to us that our candidates match your desired profile.
That is why we carry out each selection reliably, carefully and
competently and, with the candidates' consent, present you with a
complete and clear dossier.
2. contingency fee for job
placements
The success fee is calculated on the basis of 80% of
the first gross monthly income. This corresponds to the total
remuneration for the candidate's work, including all additional
allowances (e.g. bonus payments, gratuities, fixed expenses,
commission shares, etc.).
The fee is exclusive of VAT, the
first 50% is due when the employment contract is signed and is
payable net within 10 days of the invoice date.
The second payment
will be made on the 30th day of the employment contract, or after
receipt of the invoice as soon as this deadline has been exceeded. If
an employment contract is terminated within the first 25 days of
commencement of employment at the request of the employer or
employee, the second payment (remaining 50 %) shall be forfeited.
In
the case of part-time contracts (less than 80%), 65% of the fee will
be invoiced based on the hypothetical 100% gross monthly salary.

The client may pay by bank transfer.

payment deadlines and delays
Clients are responsible for timely
payment of services received and are liable for reminder and
collection fees.
In the event of late payment and consequently
after the second reminder, the customer shall compensate Work Zermatt
with an interest on arrears of 5%.
5. Obligations of the
customer
The client confirms with a signed declaration of intent
that he/she has read and understood these GTC, the confidentiality
agreement and the rights of use.
The client undertakes to
fully support the work of WORK ZERMATT and to make all arrangements
necessary for the execution of the order. This includes, among other
things, providing all relevant information and documents.
The
client is obliged to cooperate fully. The client is responsible for
the correctness of the submitted documents. He is subject to the
legal obligation to cooperate and provide information. 6.

Obligations of WORK ZERMATT
Duty to provide services
WORK
ZERMATT fulfils the agreements set out in the contract. The services
may be provided on site or at a distance.
7. contractual
obligation
The GTC, the non-disclosure agreement and the letter of
intent are legally binding on WORK ZERMATT. Changes to the Letter of
Intent must be announced and read and confirmed in writing by all
parties.
8. external costs / additional services
In the
exceptional case that external costs arise on request such as
advertising, typesetting and printing costs, additional expenses in
connection with social networks as well as services such as test and
special clarifications, these can be invoiced in addition to the fee.
9. Data protection
All information or documents
received from the client or candidate will be treated as strictly
confidential. The application documents submitted to you are to be
treated in the same way and may not be passed on to third parties
without our knowledge. Documents from unsuccessful candidates must be
returned to us or deleted. In particular, they may not be used for
other recruitments.
10. Protection of candidates
Our
clients grant WORK ZERMATT candidate protection for a period of 6
months from the first presentation of a candidate. If a contract of
employment is concluded between the client and the candidate within
this period, WORK ZERMATT is entitled to demand payment of the fee in
accordance with these GTC.
11. Effectiveness of the
conditions
The aforementioned conditions come into force when the
client places an order verbally or in writing or when WORK ZERMATT
receives the application documents from a candidate.
12. Place of jurisdiction and applicable law
The exclusive place of
jurisdiction for any disputes arising from such contracts shall be
Visp. Swiss law shall be applicable.
